The applicant is seeking pre-arrest bail in Crime No.525 of 2021, dated 06.10.2021, registered with Police Station Desaiganj, Tq. Wadsa, District Gadchiroli, for the offence punishable under Section 409 of the Indian Penal Code.

This Court vide order dated 22.02.2022, passed in Criminal Application (ABA) No.34 of 2022 and Criminal Application (ABA) No.896 of 2021 granted pre-arrest bail to the Director of the Bahujan Hitay Nagri Sahkari Patsanstha Maryadit, Desaiganj. The applicant is also Director of the said Patsanstha and the role attributed to the applicant is also similar to the role attributed to the applicants-Director to the above referred Criminal Applications.

In that view of the matter, the applicant is entitled for grant of pre-arrest bail on the ground of parity. Accordingly, I pass the following order:

a) The criminal application is allowed.

b) Order passed by this Court on 29.03.2022, granting ad-interim anticipatory bail, is confirmed with modification that the applicant shall attend the concerned Police Station as and when his presence is required.

The criminal application is disposed of accordingly.
