The petitioner has challenged the order of rejection of regular parole for the reasons of ailment of his wife. The impugned order denotes that no documentary evidence was submitted to substantiate the contention of ailment of wife.

Learned counsel for the petitioner would submit that they have already submitted the documents before Inquiry Officer. So also, the application was rejected on the ground that there is likelihood of violence, since, the victims of the crime Prity

2 / 2 23.wp201.2023 are residing in the same vicinity. It is submitted that during trial, the petitioner was residing in the same area, but no other offence was registered.

It is apparent that the petitioner's medical papers have not been considered by the authority. In view of that, we hereby quash and set aside the impugned order and direct the authority to reconsider the application by referring the medical documents as well as the grounds raised in para 2 of the petition within three weeks from the receipt of this communication.

The petition stands disposed of in above terms.
