Heard Shri V.N. Morande, advocate for the applicant and Shri R.S. Nayak, A.P.P.for the non-applicant. The applicant is arrested on 25th October, 2015 in the crime registered against him for the offence punishable under Section 302 of the Indian Penal Code on the accusation that because of some dispute regarding the agricultural land, the applicant assaulted the victim and gave blows by fists and legs. Unfortunately, the victim died because of the assault. The charge-sheet is filed. The non-applicant has not been able to show that the custody of the applicant is required for further investigation. Considering the facts on record, in my view, the applicant is entitled to be released on bail. Hence, the following order :

The applicant, having been arrested in Crime No. 2 of 2015 registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs.Twenty Thousand and two solvent sureties in the like amount.

2 ba183.16.odt ii. The applicant shall attend every date of the sessions trial before the Sessions Court, unless granted exemption by the Sessions Court.
