The respondent-accused was acquitted by the Special Judge, Amravati for the offence punishable under Sections 7(13)(i)(d) read with 13(2) of the Prevention of Corruption Act on 31st December, 2007. Being aggrieved by the said judgment, the State has come in appeal.

It reveals from the report given by Senior Police Inspector of Gadge Nagar Police Station Amravati (City) that the respondent expired on 14th of November, 2010. Copy of death certificate issued by Amravati Municipal Corporation, is annexed.

Respondent is the sole-accused person. As the accused is no more, appeal against acquittal does not survive.

Appeal stands abated.
