10th February, 2017 By the present application, the claimant seeks permission to withdraw amount of compensation deposited by the appellant. Copy of the application has been served on the counsel for the appellant on 9th March, 2016.

Perused the impugned judgment. In the facts of the case, the respondent no.1 is permitted to withdraw an amount of Rs.2,00,000-00 [rupees two lakhs only] subject to filing an undertaking that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct. The remaining amount shall be invested in Fixed Deposit.
