Heard learned counsel for the applicant.

He fairly states that the charge sheet has been filed but he has an excellent case since the question of law will have to be answered in favour of the applicant. In view of filing of charge sheet, we think the applicant should be relegated to the first available remedy namely; apply for discharge before trial Court since the charge sheet has been eventually filed. We, therefore, pass the following order.

ORDER

Criminal Application (APL) No.205/2015 is allowed to be withdrawn with liberty to take such other steps as are available in law including making an application for discharge. If such an application is made, the same shall be decided as expeditiously as possible.
