Nobody is present for the petitioner. Heard Ms H.N. Jaipurkar, learned Additional Public Prosecutor who appears by waiving notice for the respondent. 2.

From the pleadings made in the petition and the grounds taken therein, it appears that the application made by the petitioner seeking grant of remission in sentence is pending with the respondent primarily for the reason that the concerned Sessions Court, Warora has not yet sent its opinion to the respondent. If this is the case, we would issue necessary directions to the concerned Sessions Court. Accordingly, we direct the concerned Sessions Court, Warora to send its opinion in the matter, if the same is pending with it, within three weeks from the date of the order and we further direct the

wp233.2020.odt respondent to dispose of the application of petitioner in accordance with law within two weeks from the date of receipt of the opinion and in case the opinion is already received, such decision may be taken within two weeks from the date of the order.

Copy of this order be sent to the concerned Sessions Court at Warora, Dist. Chandrapur and also to the respondent for due compliance. Writ petition is disposed of accordingly.

Copy of this order be also sent to the Secretary, High Court Legal Services Sub-Committee, Nagpur to take due note in the record of the Sub-Committee of the absence of appointed counsel Shri Neel Yashwant Lade. JUDGE JUDGE Tambaskar.
