DATE : 20.4.2016 Heard Shri S.V. Sirpurkar, advocate for the applicant and Shri S.M. Bhagde, A.P.P. for the non-applicant.

The applicant apprehends arrest in crime registered against him for the offence punishable under Section 65(e) and 83 of the Maharashtra Prohibition Act, 1949. According to the prosecution, the storage, possession and sale of liquor is prohibited by the State Government in Chandrapur District, still the applicant stored the liquor in his house which is seized by the police. This Court while granting interim protection, by the order dated 11th March, 2016, directed the applicant to attend the police station daily.

In the reply filed by the non-applicant, it is stated that the applicant is not co-operating with the investigating agency and has also not abided the directions given by this Court while granting interim protection and has not attended the police station daily.

Though the learned advocate for the applicant

2 aba149.16 contends that the applicant has regularly attended the police station, considering the accusations against the applicant and as according to the prosecution, stock of liquor is seized from the house of the applicant, I am not inclined to consider the prayer made in the application. The application is dismissed.
