Heard Shri R.P. Masurkar, learned counsel for the petitioner for some time.

The challenge is to the order dated 31.03.2011 refusing approval to the appointment of the petitioner. The order mentions that in the year 2010-11, the students admitted were 58 (residential) and 28 (non-residential). The strength was not sufficient to support the fourth post of Assistant Teacher. However, the facts show that earlier approval was given to the employment of the petitioner from 05.11.2003 to 30.04.2004 and thereafter from 01.07.2004 to 30.06.2006. After the impugned order, a representation was made on 20.12.2012.

The counsel for the petitioner claims that the petitioner even today is in employment but she is not getting her salary.

121wp4200.14 respondent Nos. 1 to 3 has pointed out that this Court has yet not issued any notice.

Considering the time lapsed, we are not inclined at this stage to interfere in writ jurisdiction. However, we grant the petitioner leave to move suitable representation pointing out her present status, proof of the fact that she is still continuing in employment. If such a representation is made within four weeks, the respondents shall look into it in accordance with law within next eight weeks.

With these directions, writ petition is disposed of. No order as to costs.
