CONTEMPT PETITION NO. 108 OF 2015 I N CRIMINAL APPLICATION (APL) NO. 48 OF 2015 Anandpal Singh Gurnam Singh Jabbal__ Vs. ___Hirdesh Singh Singh Sarabjeet Singh and ors --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders --------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Mr. R.S.Renu, Advocate for petitioner CORAM :
AVINASH G. GHAROTE, J.
DATE : 28/03/2023 1] Heard Mr. Renu, learned counsel for the petitioner.
2] The petition alleges contempt of the direction contained in the judgment dated 18.2.2015 passed in Criminal Application Nos. 40/2015 & 48/2015. The judgment directs the taking of the voice samples of the respondent no.1 herein in accordance with law, provided the respondent no.1 voluntarily offers the sample.
3] A reply has been filed by the respondent no.2, which indicates that the respondent no.1 has denied to give his voice sample, which would indicate
(2) 969cp107.15+108.15 that there is no voluntary offering as contemplated by the judgment dated 18.2.2015.
4] In that light of the matter, considering the express language of the judgment dated 18.2.2015, I do not find that any violation of the order has been committed by the respondent no.1. The contempt proceedings are therefore dropped.
