Heard learned counsel for the applicant.

By way of present application, the applicant is seeking condonation of delay of 317 days in filing restoration application.

It is the contention of the learned counsel for the applicant that though review application was filed, due to inadvertence objections were not removed. He submits that the matter was notified in the cause list and now it is shown as dismissed for non-removal of office objections. He submits that applicant was unaware of such order of dismissal/refusal to register and that there is no willful or deliberate delay on the part of the applicant.

Considering the statements made in the present application on affidavit, the delay in filing restoration application is condoned. Misc. Civil Application Stamp No.26002/2019 is restored subject to deposit of costs of Rs.2000/- with the High Court Legal Services Sub-Committee, Nagpur and removal of all office objections within a period of one week.
