This application is preferred by the appellantclaimant seeking condonation of delay of 58 days in filing the application for restoration of appeal. It is submitted that appeal came to be dismissed on failure of appellant to pay deficit court fee stamp and now appellant will be paying the same within two weeks.
In view thereof, application is allowed and the delay is condoned.
Appeal is restored to its original file, subject to condition of appellant paying the deficit court fee stamp within the period of two weeks from today. On failure of appellant to do so, this application for restoration will stand automatically dismissed without reference to this court.
