This is an application for condonation of delay in filing Criminal Appeal on the ground that earlier the appellant had approached a wrong forum and thereupon after dismissal of the said proceedings the present appeal was filed. However, because of Corona-Virus the subsequent delay was caused.

The learned counsel for the respondent is opposing the present application.

However, for the reasons stated in the application and in view of the order dated 10/01/2022, passed by the Hon'ble Supreme Court of India in Misc. Civil Application No. 21 of 2022 in Suo Motu Writ Petition (C) No.3 of 2020 extending limitation due to the

2 945-APPA-328-2022 pandemic situation, I am of the opinion that sufficient cause is shown for condonation of delay.

Accordingly, the Criminal Application is allowed. The delay in filing Criminal Appeal is condoned. 6.

Appeal be registered.

The Criminal Application is disposed of accordingly.
