Learned Counsel appearing for the appellant would submit that since the accused has assured to settle the matter, for some days the applicant remained absent. From the record it was pointed out that on 18.06.2019, 12.07.2019 and 26.08.2019, the complainant was present, however, due to absence of accused and on one occasion, as Presiding Officer was on leave, the matter could not be proceeded. According to him, on some casual absence of complainant the Magistrate without giving a warning to the complainant had dismissed the complaint. In context to the submission, perused the Roznama.
