This petition takes exception to the order below Exh.16, allowing the request of the wife of the petitioner for setting aside no written statement order and permission to file writ statement on record.

The said application Exh.16 was filed in the matter relating to the restitution of conjugal rights.

The learned trial Court has considered such right as a valuable right of the parties and opined that it would be in the interest of both the parties to decide the matter on merit. It is further observed that no prejudice would be caused to the petitioner, if the wife is permitted to file written statement. Accordingly, the application was allowed vide impugned order dated 04.01.2024.

In the above referred backdrop, and considering the reasons stated in the order, while allowing the application Exh.16, I am of nd.thawre
