By this application, the respondents in First Appeal No.1316 of 2009 seeks permission to withdraw the amount of compensation deposited by the appellant. In the application, it is stated that the first appeal was dismissed for want of prosecution on 07/10/2014. No proceedings have been initiated for restoring the same.

On 01/04/2016, and 15/04/2016, time was granted to the appellant to take necessary steps. However, there is no appearance on behalf of the appellant today, though the matter has been called twice.

Hence, the application is allowed in terms of its prayer.

The civil application is disposed of.
