This is an application for withdrawal of the amount. Prayer is to permit the respondent nos. 1 and 2 to withdraw the amount of compensation deposited by the appellant. In the application it has been stated that the respondent no.1 is the mother of the deceased who is aged about 60 years. It is further stated that she is in need of financial assistance for undergoing medical treatment. There is no appearance on behalf of the appellant though the matter was called twice.

Perused the judgment o the Claims Tribunal. In the facts of the case the respondent nos. 1 and 2 are permitted to withdraw the sum of Rs. 1,50,000/- subject to filing an undertaking that in case the appeal is allowed said amount be repaid with interest at such rate the Court may direct. Remaining amount shall remain in fixed deposit. Civil application is disposed of.
