The applicant has filed this application to transfer the petition bearing Marriage Petition A1184/2023 filed by the non-applicant, pending before the Family Court at Nagpur to the Court of Civil Judge Senior Division, Amravati.

The applicant is staying at Nerpiglai, District Amravati. Two proceedings filed by the applicant under Section 498-A of the Indian Penal Code as well as petition under the provisions of the Domestic Violence Act are pending at Judicial Magistrate First Class, Morshi. The nonapplicant has filed divorce petition in the Family Court at Nagpur.

The learned Counsel for the applicant has stated that the applicant is staying at Nerpiglai, Tq. Morshi, District Amravati and two proceedings are pending at Judicial Magistrate First Class, Morshi, hence, prayed to transfer the matter from Family Court at Nagpur to the Court of Civil Judge Senior Division, Amravati 5.

The learned Counsel for the non-applicant has stated that the non-applicant is willing to settle the matter.

2 45.mca.175.25 He is paying maintenance to her and she can travel from Amravti to Nagpur to attend the Court. Hence, prayed to reject the application.

Heard both the learned Counsel for the parties. 7.

Two proceedings are already pending before the Judicial Magistrate First Class, Morshi, District Amravati. The non-applicant is attending the said proceedings at Morshi. If the divorce petition which is pending before the Family Court at Nagpur is transferred to the Civil Judge Senior Division, Amravati, it will cause no prejudice to the non-applicant and it will be convenient for both of them, if the same date is taken in all the proceedings. Hence, the application is allowed.

The petition bearing Marriage Petition A1184/2023 pending before the Family Court at Nagpur is hereby transferred to the Court of Civil Judge Senior Division, Amravati.
