DATE : 21/10/2021 After hearing for some time, when the court was not inclined to interfere in the impugned order in view of the sale deeds dated 18.02.2010, 13.05.2011 and 22.04.2013 indicating that the entire property has been sold by the petitioner/plaintiff, which position is disputed by Mr. Jetha, learned counsel for the petitioner, contending that the aforesaid three sale deeds do not relate to the entire property and the suit property is still owned by the plaintiff, and after being pointed out that this would be a disputed question of fact, requiring the recording of evidence, learned counsel Mr. Jetha for petitioner on instructions, seeks to withdraw the petition. The statement is accepted and petition is accordingly dismissed as withdrawn.
