C.A.O. NO.597/2016.

No case is made out for staying the judgment passed by the trial Court granting a decree of judicial separation, as both the parties have filed various criminal cases against each other. On a perusal of the original Record & Proceedings that were secured, we find that it would not be in the interest of justice to stay the judgment and decree for judicial separation as there would be more trouble if the wife insists on staying in the matrimonial house along with the husband despite the decree of judicial separation. The civil application for grant of stay is, therefore, rejected.
