Present application is for restoration application as appeal is dismissed for non-filing of paper-book.

Ms Babhulkar, holding for Mr M. A. Kadu, learned Advocate for appellants submitted that the conditional order passed by the Court was not noticed inadvertently, and therefore, paper-book was not filed. She further submitted that now the paper-book is ready and she will file it within six weeks. 3.

Learned Advocate appearing for respondent No.1 has no objection for restoration application. Learned Assistant Government Pleader for respondent Nos.2 and 3 has also no objection for the same.

In view of the reasons mentioned in the application, the application is allowed and delay of 321 days is hereby condoned. 5.

The civil application is disposed of.
