It is not in dispute that when suspension order was issued, petitioner was undergoing a trial. He has been acquitted subsequently. Effort of Shri Dhengale, learned counsel for the petitioner is to demonstrate that in view of the subsequent event, very foundation of suspension order has gone.

He further states that petitioner has not made any representation to the employer pointing out

In this situation, we grant liberty to petitioner to move appropriate representation to the respondent- employer. If any representation is made within a period of two weeks, respondent no.1 Employer shall consider it in accordance with law, within a period of four weeks.

With these directions and keeping all rival contentions open, Writ Petition is disposed of. No costs.
