Heard Adv. Mr.Nagman Ali appearing for the petitioners and Adv.Ms.Radha Mishra (appointed) for very same person. Learned APP has appeared in both these matters.

It is not in dispute that daughter Urja aged about 8 years has now been placed in custody of her grand-father and as such challenge in both the matters is rendered infructuous. Adv. Ali submits that since daughter has been released recently, her education is likely to suffer. He points out that prior thereto she was taking education in Paranjape School in second standard and now she is staying with her grand-father in Ambazari area. He has indicated 3 to 4 schools located in the vicinity and claims that in peculiar situation and particularly as per provisions of Right of Children for Free and Compulsory Education Act, 2009, Urja is entitled to be admitted in nearby school.

Learned APP has submitted that at this stage as this grievance has not appeared in black and white, he has no instructions in

We find that grand-father of Urja can be granted liberty to make representation to concerned Education Officer seeking her admission in the neighbouring school. He shall make said representation within one week and it shall be decided in further one week.

Leaving all rival contentions in relation to this aspect open and with this direction, we dispose of the petitions. Counsel charges in Criminal Writ Petition No.372 of 2015 (for counsel appointed) are fixed at Rs.1500/-. JUDGE JUDGE Chute.
