IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH AT NAGPUR WRIT PETITION NO.1782/2016 Mrs. Nandini Pravin Thete ...Versus...

State of Maharashtra, through Secretary, Law & Home Department, Mantralaya, Mumbai - 32 and others - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Office Notes, Office Memoranda of Coram, Court's or Judge's orders appearances, Court's orders of directions and Registrar's orders - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Mrs. S.W. Deshpande, Advocate for petitioner Mrs. B.H. Dangre, G.P. for respondents CORAM : SMT. VASANTI A. NAIK AND V.M. DESHPANDE, JJ.

DATE : 21.03.2016 By this petition, the petitioner challenges the selection procedure for recruitment of law officers (Group-A) as per the advertisement, dated 1.3.2016 on the ground that the State Government is not conducting any written examination for the candidates seeking appointment in Mumbai and Amravati region, whereas a written test is contemplated for the candidates seeking appointment as law officers in the Nagpur region. It is stated that the action on the part of the respondents in conducting the written examination only for the law officers to be appointed in the Nagpur region is arbitrary and discriminatory. Mrs. Dangre, the learned Government Pleader appearing on behalf of the respondents states, on instructions,

2103wp1782.16.odt that the law officers would not be appointed in any region in the State of Maharashtra without conducting a written examination for gauging the basic knowledge of the candidates that are desirous of seeking appointment as law officers. It is stated that a written test would be conducted for the candidates seeking appointment as law officers in Nagpur region and also in Mumbai and Amravati region.

In view of the statement of the learned Government Pleader, there is no reason to proceed with the writ petition any longer. The writ petition is, therefore, disposed of by accepting the statement made by the learned Government Pleader on behalf of the State Government.

Order accordingly. No costs.

JUDGE JUDGE Wadkar
