Shri Mirza, the learned counsel for the petitioner, states that the Central Government has directed that fresh elections to the Maharashtra State Haj Committee be conducted after holding that the respondent no.5 is ineligible for contesting the election. It is stated that the cause for filing the writ petition would not survive in view of the subsequent development. Shri Jaiswal, the learned Senior Counsel appearing for the respondent no.5, states that the order of the Central Government is challenged by the respondent no.5 before the Principal Seat.

Be that as it may, since the petitioner is not desirous of prosecuting the writ petition in view of the subsequent development, the petition is disposed of on the prayer made by the learned counsel for the petitioner for withdrawal of the petition. The writ petition stands disposed of as withdrawn. The points raised in the petition are, however, kept open.
