There are disputed questions of fact which in my view cannot be effectively adjudicated in the extraordinary jurisdiction. Hence, I am not inclined to interfere with the impugned order, however, the petitioner will be at liberty to approach the Civil Court as per Section 22 of the Mamlatdar's Courts Act 1906, if so advised.

With the above observations, the writ petition is dismissed. In the circumstances, the parties to bear their own costs.
