Prayer is to withdraw the amount of compensation that has been deposited by the appellant in terms of enhancement granted by the reference Court. It is stated that the respondent has become landless due to aforesaid acquisition.

Application is opposed by learned counsel for the appellants on the ground that enhancement granted by the Reference Court is on a higher side.

Considering the material available on record the respondent is permitted to withdraw the amount of Rs. 15,00,000/- subject to furnishing undertaking in this Court that in case the appeal is allowed the amount withdrawn shall be repaid with interest at such rate the Court may direct.
