Heard the learned Counsel Shri. N. S. Warulkar for Applicant.

The sole respondent has been served but has not bothered to appear either by himself or through Counsel.

This is an Application seeking transfer of Petition A-22/2021 pending in the Family Court at Parbhani to the Family Court At Akola for adjudication.

The learned Counsel Shri. Warulkar points out that the Applicant-Wife has filed three proceedings before the Family Court at Akola concerning judicial separation, maintenance and execution of the maintenance order. Shri. Warulkar, the learned Counsel further points out that despite of order of maintenance, there is no compliance on the part of the Respondent.

The learned Counsel Shri. Warulkar points out the distance between Akola and Parbhani is almost 200 kms. and it will not be possible for Applicant to attend the proceedings at Parbhani. He points out that the

36 MCA-258-2021 Respondent is also not paying the maintenance despite directions from the Family Court, Akola.

Having regard to all the aforesaid circumstances as also the fact that almost three proceedings are pending in the Family Court at Akola, it will be in the interest of justice to transfer the application, it is hereby allowed. The proceedings, in the Family Court at Parbhani instituted by the Respondent, are transferred to the Family Court at Akola.

This Application is therefore made absolute in terms of prayer Clause (i), which reads as follows : (i) "Allow the instant application and thereby transfer Petition A-22/2021 filed by the Non-applicant which is pending on the file of learned Family Court, Parbhani to learned Family Court at Akola for its adjudication, in the interest of justice."

Registry to take necessary steps to effect to the aforesaid order.
