Shri Harshal Dube, learned Additional Public Prosecutor waives notice for respondent. He states that the reply is ready and seeks permission of the Court to place it on record. Reply is taken on record.

It is not disputed that this applicant is similarly situated with the co-accused Ashish, Prashant, Pravin, Abhishek and Balu @ Roshan all of whom have been granted regular bail by this Court.

In my opinion, this applicant will also be entitled to be released on bail. It is directed that the applicant be released on bail in Crime No. 398/2017 registered with Police Station, Tiroda for the offences punishable under Sections 302, 323, 294, 109, 147, 148 and 149 read with Section 34 of the Indian Penal Code on his furnishing PR Bond of Rs. 25,000/- together with one solvent surety in the like sum, on the following conditions :

(1) Applicant shall attend Police Station, Tiroda twice in a month i.e. on 2nd and 4th Saturday till completion of the

(2) Applicant shall attend the trial Court on all the dates fixed by it in the trial.

(3) Applicant shall cooperate with the trial Court in expeditious disposal of the trial.

(4) Applicant shall not tamper with prosecution evidence in any manner.
