The applicants are seeking pre-arrest bail apprehending arrest in crime registered against them for offences punishable under Sections 406 and 420 read with Section 34 of the Indian Penal Code, on the accusations that the applicants were working as agents of Shree Surya Investment Company which has duped many investors of crores of rupees. It is alleged that the investors have deposited substantial amount because of the persuasion of the applicants.

The applicants are granted bail by the Sessions Court by the order dated 17-07-2014 in separate crime registered against them in similar offence on similar
2 aba145,159.16 accusations. Co-accused Mrs. Pallavi Sameer Joshi is granted bail by this Court on 14-07-2015.
Considering the nature of accusations against the applicants, the averments regarding their participation in the offence and as the non-applicant has not been able to show that custody of the applicant is required for further investigation, in my view the applicants are entitled to be released on bail, however, on certain conditions. 4.
Hence, the following order :
i) In the event of arrest in Crime No.82/2015 registered by the non-applicant, the applicants be released on bail, on furnishing P.R. Bond for Rs.50,000/- each and two solvent sureties in the like amount for each of the applicant.
ii) The applicants shall surrender their Passports with the Investigating Officer within one week. If the Passport Authority has not issued Passport in the name of any of the applicant, an affidavit to that effect shall be submitted to the Investigating Officer within one week.
iii) The applicants shall attend the Police Station Wadgaon Road, District Yavatmal on every Wednesday, till 15-07-2016.
iv) The applications are allowed in the above terms.
