Date : 30 th September, 2015 In view of the objection raised by the learned counsel for the respondent that the present writ petition is not maintainable in view of the existence of alternate statutory remedy of filing a second appeal under Section 100 of the Code of Civil Procedure, the learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file a second appeal.

Permission is granted.

The writ petition is dismissed as withdrawn with liberty as prayed for.

The interim order passed by this Court shall continue for a further period of three weeks, at the end of which it shall stand automatically vacated without reference to the Court. Judge.
