APRIL 27, 2018 Heard. Perused the reply of the prosecution and the case diary.

It is seen that except for the allegation made by the co-accused that major portion of the sale proceeds was received by this applicant, there is no other allegations made or there is no material present on record showing that this applicant played any active role in commission of the offences alleged against him. If this is so, I am of the that there is, prima facie, doubt about making out of allegations against this applicant.

In the result, the application is allowed.

Ad-interim anticipatory bail granted to this applicant by this Court on 13th March, 2018 is hereby

ABA159.18 confirmed on the same conditions, with the clarification, now, that this applicant need not attend the police station except when he is called upon to do so by the Investigating Officer.
