DATE : 22.3.2016 Heard Shri D.M. Dixit, advocate for the applicant and Shri N.S. Khubalkar, A.P.P. for the non-applicant. The applicant is arrested on 12th November, 2015 on the accusation that she gave contract to accused Rahul, Lankesh and Ravi to kill her son. According to the prosecution, the applicant lodged report in police station alleging that someone had committed murder of her son Mahesh in Lokhande Apartment, that on investigation, Rahul, Lankesh and Ravi were arrested and one of them disclosed that the applicant had agreed to give them Rs.10,000/- for killing her son Mahesh and had given Rs.5,000/- in advance.
The learned A.P.P. has relied on the statement of Laxmi Jaguram Bhautik to show that the applicant is involved in the crime. The charge-sheet is filed on 3rd February, 2016.
Considering that the applicant is woman aged about 58 years, the fact that the non-applicant has not been able to show that the custody of applicant is required for further investigation and in view
2 ba131.16 of the facts on the record, I am convinced that the applicant is entitled to be released on bail.
Hence, the following order:
(i) The applicant having been arrested in Crime No.394/2015 registered by the non-applicant, she be released on bail on furnishing P.R. bond for Rs.10,000/- (Rs. Ten Thousand Only) and one solvent surety in the like amount.
The application is allowed in the above terms. CRIMINAL APPLICATION (APPP) NO.356/2016.
In view of disposal of main application, this application does not survive and is disposed of accordingly.
