The applicant is arrested on 4th February, 2016 in crime registered against the applicant, his two sons and one other person for the offence punishable under Section 307 read with Section 34 of the Indian Penal Code.

The accusations against the applicant are that when the assault was going on he came there and joined the co-accused in the assault.

Considering the nature of accusations, the fact that the applicant is aged about 70 years and that the reply which was filed by

2 ba197.16 the non-applicant before the Sessions Court does not show that the custody of applicant is required for further investigation, in my view, the applicant is entitled to be released on bail. Hence, the following order:

(i) The applicant having been arrested in Crime No.27/2016 registered by the non-applicant, he be released on bail on furnishing P.R. bond for Rs.10,000/- (Rs. Ten Thousand Only). (ii) The application is allowed in the above terms. JUDGE Tambaskar.
