Ms. R.V. Kalia, APP for State.

CORAM : S. B. SHUKRE, J DATE : 27.4.2018.

Heard. Perused the charge-sheet and reply of the prosecution.

I have also gone through the order passed on 28-11-2017 in Bail Application No. 1046 of 2017. Upon consideration of the facts and circumstances of the case, I find that it is difficult to distinguish the case of this applicant from that of co-accused Akash Prabhakar Wadhve who has been granted regular bail by this Court on 28-11-2017. If there are discrepancies in the version of the complainant and the other eye witnesses so far as the case of prosecution case against co-accused Akash is concerned, same discrepancies would also be there in the case of the prosecution as against this applicant. Therefore, on the ground of parity, the applicant would be entitled to be released on bail.

Application is allowed and it is directed that the

2 ba226of2018 5 applicant be released on bail on his furnishing P.R. Bond in the sum of Rs. 30,000/- together with one solvent surety in like sum, on the following conditions:

[i] The applicant shall cooperate with the police in the investigation.

[ii] Applicant shall regularly attend the trial Court on all dates of hearing as may be fixed by the trial Court. [iii] Applicant shall cooperate with the trial Court in expeditious disposal of the trial.

[iv] The applicant shall not tamper with the prosecution witnesses in any manner.
