The applicant is arrested on 11-02-2016 in crime registered against him for the offences punishable under Sections 376(2)(i) of the Indian Penal Code and Section 5(l) and 6 of the Protection of Children from Sexual Offences Act, 2012.

The accusations against the applicant are that he has repeatedly committed penetrative sexual assault on the victim, aged about 15 years.

Considering the facts on record, the nature of accusations and the fact that the non-applicant has not been able to show that custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

Hence, the following order :

i) The applicant having been arrested in Crime No.28/2016 registered by the non-applicant, he be released on bail, on furnishing P.R. Bond for Rs.10,000/- and one solvent surety in the like amount.
