The applicant is apprehending arrest in Crime 40/2020, registered with Police Station, Dabki Road, Akola, for offence punishable under sections 379, 420,465, 467, 471 read with section 34 of Indian Penal Code and sections 21 and 22 of the Mines and Minerals (Development and Regulation) Act.

Vide order dated 17.3.2020, the applicant was granted interim protection, noting the submission of the learned counsel that the truck which was allegedly involved in illegal transportation of sand, was sold vide notarized agreement, prior to the alleged transportation. 4.

While, the applicant is still recorded owner of the vehicle in the RTO record, it does appear, at least prima facie, that he had entered into an agreement and the possession of the vehicle was delivered. It is fairly stated by the learned APP Mr. I.J. Damle that the seized vehicle was

The interim protection granted vide order dated 17.3.2020 is made absolute.
