Mr. F.T. Mirza, the learned counsel appears for respondents 1 to 8.

Since none appeared on behalf of the petitioners on 11.8.2022, the following order was passed:

"None appears on behalf of the petitioners.

The learned counsel Mr. F.T. Mirza, who appears on behalf of the respondents 1 to 8 states that an attempt was made to serve copy of Civil Application 400/2022 on the learned counsel Mr. R.V. Gaikwad and Mr. S.M. Patrikar who have filed Vakalatname on behalf of the petitioners. 3.

Mr. F.T. Mirza states that the said counsel have informed that their clients have taken back the brief. Notices were issued by the contesting respondents to the petitioners and while

wp1582.2011.odt notice issued to petitioner 1 could not be served due to insufficient address, petitioner 2 is reportedly dead.

We note from the affidavit placed on record that the respondents 1 to 8 have complied with the order dated 6.6.2022 and an amount of Rs. 71,00,000/- (Rupees Seventy One Lacs) is transferred to the Army Central Welfare Fund. 5.

Presumably, the petitioners are not interested in prosecuting the petition.

However, we adjourn the hearing to 23.8.2022 to afford final opportunity to the petitioners to assist the Court, if deem fit." 3.

The petition is dismissed with cost of Rs. 5,000/- (Rupees Five Thousand) to be deposited with the High Court Legal Services Sub-Committee, Nagpur.

If any application for restoration is preferred, the Registry shall ensure that the direction to pay cost is duly complied with.
