This is an application seeking permission to serve the respondent no.1 and to correct the address of respondent no.2 in the array of respondents in the first appeal. 2.

Shri Mirache, learned counsel appearing for the applicant/appellant submits that the respondent no.1 could not be served for want of permanent address and seeks service by way of substituted mode i.e. by paper publication in "Punya Nagri" newspaper. The learned counsel also draws the attention of this Court to paragraph 3 of the application to submit that the respondent no.2 has also not been served and he has now obtained the correct address of respondent no.2 and also seeks to serve respondent no.2.

Having heard the learned counsel for the applicant and having perused the application, the following order is passed :

O R D E R

i) Re-issue notice, returnable on 10.11.2022.

ii) Let the notice be published in "Punya Nagri"

iii) As far as respondent no.2 is concerned, let the Registry issue notice to the said respondent on the correct address by the next date.
