The applicant has filed this application under Section 439(2) of the Code of Criminal Procedure praying that the order passed by the learned Additional Sessions Judge on 1st February, 2016 in Bail Application No.70 of 2016 granting pre-arrest bail to the non-applicant No.2 be set aside. With the assistance of the learned advocate for the applicant and the learned A.P.P., I have examined the documents placed on record of the application as also the order passed by the learned Additional Sessions Judge on 1st February, 2016. In paragraph 6 of the order the learned Additional Sessions Judge has dealt with all the relevant aspects which are required to be adverted to while considering the application for grant of pre-arrest bail. The impugned order cannot be faulted with. I see no reason to grant the prayer made in the present application. The criminal application is dismissed.
