(2) The applicant is apprehending arrest in Crime 1338/2019 registered with Police Station, Ramnagar, Chandrapur for the offence punishable under Sections 307, 364, 364A, 384, 386, 325, 143, 147, 148, 149, 504, 506 and 120B of the IPC and under Sections 3 and 25 of the Arms Act.

(3) Applicant was granted interim pre arrest protection vide order dated 17.03.2020.

(4) The charge-sheet is filed, albeit under Section 299 of the Cr.P.C. since the applicant is shown as absconder. However, perusal of the report reveals that the only role attributed to the applicant is that he called the complainant telephonically and while the complainant was waiting on the

5 aba186.20.odt road, the other accused abducted him. No further overt act is attributed to the applicant.

(5) I am satisfied that applicant has made out a case for confirm the interim pre arrest protection. The interim pre arrest protection granted vide order dated 31.03.2020 is made absolute.
