Heard Shri Sahil Dewani, learned advocate for the petitioner and Shri Chutke learned Additional Public Prosecutor for the respondent/State. Learned Additional Public Prosecution has raised the point that in view of the Arms Act, 1959 and the Rules, the appeal is provided to challenge the impugned order dated 1st November, 2023 passed by the respondent no.2. 2.

After making submissions ultimately, the learned advocate for the petitioner seeks withdrawal of the petition to approach the appellate authority. In view of the fact that there is alternate efficacious statutory remedy, the petitioner is allowed to withdraw the petition to approach the appellate authority. 3.
