DATE : 6.4.2016 Heard Shri V.N. Morande, advocate for the applicant and Shri S.S. Doifode, A.P.P. for the non-applicant. The applicant is arrested on 10 th April, 2015 in crime registered against him and another accused for the offence punishable under Sections 376(D), 506 and 34 of the Indian Penal Code and Sections 4, 6, 8 and 10 of Protection of Children from Sexual Offences Act, 2012.
The complainant (aged about 16 years at the time of incident) has lodged report that on 9 th April, 2015 at about 11 p.m.
when she was asleep in her courtyard, the applicant woke her and
2 ba207.16 called her near the house of Siddhamshettiwar and Sumitrabai and then committed penetrative sexual assault and threatened her of dire consequences. The charge-sheet is filed. The non-applicant has not been able to show that the custody of applicant is required for further investigation.
Considering the medical examination report of victim and the facts on the record, in my view, the applicant is entitled to be released on bail.
Hence, the following order:
(i) The applicant having been arrested in Crime No.35/2015 registered by the non-applicant, he be released on bail on furnishing P.R. bond for Rs.10,000/- (Rs. Ten Thousand Only) and one solvent surety in the like amount.
(ii) The application is allowed in the above terms. JUDGE Tambaskar.
