DATE : March 22, 2017 The claimants seek permission to withdraw the amount of compensation deposited by the appellants. In the application it is stated that the respondent No.5 is to get married on 04/05/2017 and hence the claimants be permitted to withdraw the amount of compensation. Copy of the application has been served on the counsel for the appellant.

Perused the impugned judgment. Considering the nature of evidence on record, the claimants are permitted to withdraw an amount of Rs.1,50,000/- subject to filing an undertaking that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct. On submitting such undertaking the claimants shall be permitted to withdraw the aforesaid amount from the Claims Tribunal, Bhandara. Civil application is allowed and disposed of. JUDGE Asmita
