DATE : AUGUST 16, 2019 P.C. :- The writ petition questions a condition of the notice inviting tender requiring the successful bidder to furnish a bank guarantee in sum of rupees thirty lacs. The tender is to transport water and estimated cost of transportation as per counter affidavit filed is rupees two crores.

Keeping the issue open whether such condition is designed to create cartel, we dispose of the petition as infructuous for the reason as per the notice inviting tender water has to be transported for a period of one year. On
