Heard learned Counsel for the applicant extensively as well as learned APP. After going through the investigation papers, it reveals that the entire case is rested on the circumstantial evidence. The knife is recovered at the instance of the present applicant. At this stage, I have shown my disinclination to grant bail to the present applicant.

In view of that, learned Counsel for the applicant seeks permission to withdraw the application with liberty to file afresh after receipt of the CA report. 4.

Permission is granted to withdraw the application.

The application is disposed of as withdrawn with liberty as prayed for.
