For the reasons stated in the application, the complainant is permitted to assist the prosecution. Criminal application is allowed.

Heard Shri A.S. Mardikar, learned Senior Advocate assisted by Shri S.G. Joshi, Advocate for the applicant, Shri A.D. Sonak, Additional Public Prosecutor for the non-applicant and Shri S.V. Sirpurkar, Advocate for the complainant.

The applicant is arrested on 07-11-2015 in crime registered against four persons (including the applicant) for offences punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code and Sections 3,4,25,27,29 and 30 of the Indian Arms Act.

According to the prosecution, co-accused Ranjeet Chungle has committed the murder of victim and the

2 ba209.16 applicant who is an employee of Ranjeet Chungle, has assisted the main accused in destroying the evidence. 4.

The charge-sheet is filed. The investigation is complete.

Considering the nature of accusations against the applicant and as it is not shown by the non-applicant that custody of the applicant is required for further investigation, in my view, the applicant is entitled to be released on bail.

Hence, the following order :

i) The applicant having been arrested in Crime No.169/2015 registered by the non-applicant, he be released on bail, on furnishing P.R. Bond for Rs.50,000/- and two solvent sureties in the like amount.

ii) The applicant shall regularly attend the sessions trial on every date unless granted exemption by the Sessions Court.
