The Petitioner has challenged the order passed by the Divisional Commissioner, Amravati allowing the complaint filed by Respondent No.7-Caveator, disqualifying the Petitioner from holding the post of Sarpanch and Member of Gram Panchayat Wadali Deshmukh, Taluq Akot, District Akola under the provisions of Section 39[1] of the Maharashtra Gram Panchayat Act, 1959 before the Appellate Authority i.e. the State Government and the

Order 1804wp1937-22 appeal is pending.

Consequent to the disqualification of the Petitioner, fresh elections were held and new Sarpanch has been elected. 3.

This Writ Petition had come up on board on 11 April 2020, when it was adjourned to 13 April 2022 as the Counsel for the Caveator was not present. Thereafter again on 13 April 2022, the matter was adjourned till today since the Counsel for the Caveator was not present. Today also no one appears for the Caveator. No alternate arrangement has been made. In light thereof we dispose of this Writ Petition by observing that the outcome of the elections held to the post of Sarpanch consequent to the disqualification of the Petitioner would be subject to the decision in the pending appeal. 4.

Writ Petition is accordingly disposed of.
