Perused the application and the afÏdavit filed along with it. There is no reason given in the application and there is some semblance of reasons, which can be culled out from the afÏdavit submitted after filing of the application by the petitioner. Considering the nature of the issue involved in this case and also whatever the explanation, the petitioner has given, I find that this application can be allowed subject to payment of costs of Rs.10,000/-. The application is allowed accordingly.

The order of dismissal of the writ petition is recalled and the petition stands restored to the original

mca.512.15 2/2 file, subject to the condition that the petitioner pays and deposits costs of Rs.10,000/- (Rupees Ten Thousand Only) with Bombay High Court Legal Services Sub-Committee, Nagpur within a period of two weeks, failing which, this order shall stand automatically cancelled and the order of dismissal of the petition shall get revived.
