A challenge raised in this petition is to the judgment and order dated 24.12.2021 passed by the Maharashtra Administrative Tribunal, Nagpur, in Original Application No.19 of 2016 by which the learned Tribunal has directed to respondent/State therein, to consider the application of the applicant No.2 (respondent No.2 herein) for appointment on compassionate ground and include her name in the waiting list.

The other contention of the petitioner is that since the candidate has crossed the age limit of 40 years, she is not entitled for the benefits.

Be that as it may, the said issue has already been covered by the Judgment of the Full Bench of this Court in Writ Petition No.3701 of 2022 (Kalpana Wd/o. Vilas nd.thawre
